New Law in Tennessee Requires Parental Consent

The Family Rights and Responsibilities Act took effect on July 1, 2024, in Tennessee. It introduces significant changes to healthcare practices by emphasizing parental consent. This law ensures parents have exclusive authority over their child’s physical and mental healthcare decisions. Furthermore, it highlights the critical role of parental involvement in such matters.

Key Provisions for Healthcare Professionals

Healthcare professionals should note that the law exclusively reserves parental rights to a parent without government obstruction. Moreover, parents now hold full authority to make all physical and mental healthcare decisions for their child. They also maintain the right to consent to all physical and mental healthcare on their child’s behalf.

Impact on the Dental Profession

From our perspective in the dental profession, it has been customary for parents or legal guardians to sign the consent forms for dental treatment.

Previous Access to Healthcare for Teens

Prior to this new law in Tennessee, teens had access to certain healthcare services such as birth control, treatment for STDs, and pregnancy testing in public health clinics, including teens as young as 14.

Changes Under the New Law

With the new law in place in Tennessee, health departments must now obtain parental consent by having a parent present or providing verbal consent over the phone for such services for minors.
